SPECIAL MEETING OF TOWN PLANNING COMMITTEE

Planning Application
20 Piney Lane
The Committee was reminded that, at its meeting on 22nd March, it had, in order to permit deputations to attend, deferred consideration of an application for the demolition of a dwelling at 20 Piney Lane to enable the erection of six apartments. It was reported that Dr. D. Beirne, objector to the application, was in attendance and he was admitted to the meeting and welcomed by the Chairman (Councillor Patterson).
Dr. Beirne outlined his concerns in relation to the proposed development. He indicated that the application, if permitted, would:
(i) be out of character with the residential amenity of the local area;
(ii) set an unacceptable precedent for a future developments of a similar nature; and
(iii) be detrimental to residential amenity as it would result in increased traffic in the area and therefore be hazardous to road safety.
Dr Beirne then retired from the meeting.
It was reported that Mr. T. Davis and Mr. P. Gillespie, the applicant and his representative, were in attendance and they were admitted to the meeting and answered a number of the questions which had raised by Dr, Beirne. Mr. Gillespie stated that the proposed development was intended specifically for older residents of
the South Belfast area who might wish to downsize their living accommodation. He indicated that the plans for the house had endeavoured to take into account the character of the area and that the Roads Service had raised no concerns in respect of road safety. The Chairman thanked Mr. Davis and Mr. Gillespie for attending and they retired from the meeting.
The Committee noted that the application would be resubmitted for further consideration in due course.
32C Upper Malone Road
The Committee considered an application for the change of use from a retail unit to a ground floor hot food bar, to incorporate a restaurant on the first floor, to include an extension, relocation of automated telling machine and shop front alterations at 32C Upper Malone Road. It was reported that Mr. Caskies, together with Ms. J. Ingram and Ms. E. Dorrity, objectors to the application, were in attendance and they were admitted to the meeting and welcomed by the Chairman (Councillor Patterson).
Mr. Caskies indicated that the application, if permitted, would result in an increase in anti-social behaviour due to the nature of the business to be established which he suggested would encourage youths to gather in the area. He cited issues regarding noise and litter pollution, together with the potential problem of unpleasant odours from the hot food bar. He indicated that the establishment of a hot food bar, together with a restaurant, would lead to increased traffic congestion which would be detrimental to road safety. Mr. Caskies stated that insufficient provision had been made within the proposal for the storage of waste on the premises.
The deputation then answered several questions which were put to them by the Members and they then retired from the meeting.
Mr. M. Tennyson, representing the applicant, was in attendance and he was admitted to the meeting. Mr. Tennyson indicated that issues regarding odour and refuse collection had been addressed through the consultation with the Council's Environmental Health Department and that the Roads Service had raised no comment in relation to traffic congestion. He indicated that, in respect of the potential for anti-social behaviour, his client would be prepared to abide by any reasonable stipulations regarding the opening and closing of the establishment which might be imposed. The Chairman (Councillor Patterson) thanked Mr. Tennyson for attending and he retired from the meeting.
The Committee noted that the application would be resubmitted in due course.
