Apologies for inability to attend were reported from the Deputy Lord Mayor (Councillor Patterson) (Chairman), Councillor Mullaghan (Deputy Chairman) and Councillor P. Maskey.
Minutes
The minutes of the meeting of 16th November were taken as read and signed as correct. It was reported that those minutes together with the minutes of the 26th October, 2nd and 7th November had been adopted by the Council at its meeting on 4th December, subject to the omission of the matters in respect of which the Council had delegated its powers to the Committee.
Routine Correspondence
It was reported that correspondence had been received from various Statutory Bodies in connection with the undernoted items:

Correspondence had been received also from the Roads Service advising the Committee of amendments to the On-Street Parking Order (Northern Ireland) 2000 in relation to changes within the Belfast controlled parking zones resulting from a review of parking controls.
Copies of the Orders letters and maps relating to the above-mentioned matters were displayed at the meeting for the information of the Members.
Requests for Deputations
It was reported that requests to address the Committee had been received from objectors to the undernoted planning applications. Accordingly, the Committee agreed to receive representatives of the objectors and the applicants at a future meeting of the Committee:

Planning Advice Line
The Committee was advised that correspondence had been received from Community Technical Aid advising the Council of the establishment of a new planning advice line service. The service was intended primarily for disadvantaged individuals who would require advice on planning issues and would not be eligible to receive free advice from other sources.
The Members Support Officer stated that the Planning Advice Line had received financial support from the Planning Service and that the part-time service would be monitored and, if necessary, additional resources would be provided on a full-time basis in the future.
The Committee noted the information which had been provided.
Advanced Notification of Listing of Buildings of Special Architectural or Historic Interest
Barnett's Stable Yard and Courtyard Wall, North West of Malone House, Upper Malone Road
The Committee was advised that correspondence had been received from the Environment and Heritage Service indicating that, after due consideration and further consultation, the Department had decided not to proceed with the statutory listing of the above-mentioned property.
Noted.
26 Sans Souci Park
The Committee was advised that the Department for the Environment was considering currently the delisting of the above-mentioned property since there had been inappropriate alterations to the exterior, the attic floor layout had been altered and many original fireplaces had been replaced.
The Committee noted the information which had been provided and agreed to offer no comment in the matter.
Stable Block (Ormiston Mews), Ormiston House, 50 Hawthorne Deane Road
The Members' Support Officer advised the Committee that correspondence had been received from the Environment and Heritage Service indicating that the above-mentioned building was being considered under Article 42 (1) of the Planning (Northern Ireland) Order 1991, as a property worthy of listing as a building of special architectural or historic interest. The Environment and Heritage Service had indicated that it would welcome the Council's views in this regard and that should no views be received within six weeks of the date of the correspondence, it would be assumed that the Council was in agreement with the listing of the above-mentioned property.
After discussion, the Committee noted the information and agreed to offer no comment in the matter.
Council Consultation Procedures
The Members' Support Officer advised the Committee that correspondence had been received from the Divisional Planning Manager which had provided additional information in respect of the procedures to be undertaken should the Committee seek to defer a planning application. The Committee was advised that the Members' Support Officer had consulted with the Divisional Planning Manager in relation to the new information and he suggested that the new measures would not materially affect the way in which the Committee conducted its business in regard to the consultation process.
The Committee noted the information which had been provided.
Planning Appeals
Notification of Appeals Lodged
The Committee was informed that correspondence had been received from the Divisional Planning Manager indicating that the undernoted planning applications had become subject to an appeal in default of a planning decision under Article 33 of the Planning (Northern Ireland) Order 1991.

The Committee was informed that there remained a number of issues outstanding in relation to the Planning Services consultation with the Roads Service in respect of both applications.
During discussion, several Members pointed out that the Committee, at its meeting on 2nd November, had considered a major planning application in relation to this location and an adjoining site, in respect of the proposed development of a superstore, carparking, access and service arrangements, landscaping and associated developments. The Committee had expressed its concern that the proposal would have an impact on the surrounding neighbourhood, particularly in relation to traffic congestion and parking problems. It had agreed to advise the Planning Service that the development of the site at 160-220 Castlereagh Road should be dealt with by means of a public local enquiry before the Planning Appeals Commission, in order to permit all local issues to be debated and considered adequately.
The Committee noted that responses were still outstanding from the Roads Service in relation to the two applications and expressed concern that the development to which the applications referred would have a detrimental impact on the neighbourhood in relation to associated traffic and parking problems.
Planning Applications
Reconsidered Item - Change of Opinion 152 Cavehill Road
The Committee considered further the application in respect of the change of use from a dwelling to a crèche, provision of a conservatory, replacement of existing single-storey rear extension for office use at 152 Cavehill Road for which the Divisional Planning Manager had issued a revised opinion to grant approval.
During discussion, several Members indicated that the policy whereby the Committee was permitted to defer an application on one occasion only created difficulties when that one deferral resulted in a change of opinion by the Planning Service and they expressed the view that clarification on this anomaly was required from the Planning Service.
After further discussion, it was
Moved by Councillor Maginness, Seconded by Councillor Hanna,
That the Committee agrees to reject the opinion of the Divisional Planning Manager to approve the change of use of a dwelling to a crèche, the provision of a conservatory and the replacement of a single-storey rear extension at 152 Cavehill Road on the grounds that the development would have an adverse effect on adjacent residential properties due to noise, nuisance and distrubance and would increase traffic congestion on an already busy Cavehill Road.
On a vote by show of hands three Members voted for the proposal and nine against and it was accordingly declared lost.
Accordingly, the Committee agreed to accept the recommendation to approve the application.
(As the decision was not unanimous it was subject to ratification by the Council.)
