MEETING OF TOWN PLANNING COMMITTEE

Members present: Councillor Adamson (Chairman); the Deputy Lord Mayor (Councillor O’Donnell); the High Sheriff (Councillor Patterson); and Councillors D. Browne, Empey, Hutchinson, Lavery, Long, Maginness, McCarthy, McClenaghan, M. McGimpsey, H. Smyth, Walsh and Wilson.

Minutes

The minutes of the meeting of 18th November, which had been printed and circulated, were taken as read and signed as correct. It was reported that those minutes, together with the minutes of 4th November, had been adopted by the Council at its meeting on 1st December, subject to the omission of matters in respect of which the Council had delegated its powers to the Committee.

Correspondence Received

It was reported that correspondence had been received from the various Statutory Bodies in connection with the undernoted items:

Notice of intention to create a Disabled Parking Bay at 119 Larkfield Road

Notification of intention to introduce traffic calming measures in the Highbury Gardens area

Notice of the proposed Abandonment of a footpath between 5 and 7 Westrock Gardens

Notice of the proposed Abandonment of a link road between Albert Bridge and Short Strand

Copies of the letters, Orders and maps relating to the above-mentioned matters were displayed at the meeting for the information of the Members.

The Committee noted the information which had been received.

Review of the Planning Agreement with Belfast City Airport

The Members’ Support Officer informed the Committee that correspondence, copies of which had previously been circulated, had been received from the Planning Service indicating that it had launched a public consultation into the review of the current Planning Agreement with Belfast City Airport. As part of the consultation process the Planning Service was seeking the views of local elected representatives.

After discussion, it was agreed that the Members’ Support Officer provide, for the next meeting of the Committee, a report in respect of the above-mentioned matters, taking account of the views of the Health and Environmental Services and Development Departments.

New Planning Service Subordinate Legislation

The Members’ Support Officer reported that correspondence, copies of which had previously been circulated, had been received from the Planning Service advising that two new Statutory Rules entitled the Planning (Use Classes) Order (Northern Ireland) 2004 and the Planning (General Development) (Amendment) Order (Northern Ireland) 2004 had come into operation on 29th November, 2004. The Planning (Use Classes) Order (Northern Ireland) 2004 he stated, replaced and revoked the same Order of 1989. He added that the Planning (General Development) (Amendment) Order (Northern Ireland) 2004 amended the same Order of 1993.

The Committee noted the correspondence which had been received.

Planning Applications

64 Andersonstown Road

The Committee considered an application relating to the construction of four retail units and seven duplex apartments with six garages at the above-mentioned location in respect of which the Divisional Planning Manager had issued an opinion to approve. After discussion, it was

Moved by Councillor Walsh, Seconded by Councillor Maginness, and

Resolved – That the Committee agrees to reject the recommendation of the Divisional Planning Manager to approve the above-mentioned application at 64 Andersonstown Road on the grounds that the proposed development would, if permitted, result in the over-intensification of the use of the site.

On a vote by show of hands, six Members voted for the proposal and six against. As there was an equality of votes, the Chairman exercised his second and casting vote in favour of the proposal and it was accordingly declared carried.

(As the decision was not unanimous it was subject to ratification by the Council.)

29A Cranmore Gardens

The Committee considered an application relating to amendments to the design and orientation of a previously approved application for the erection of one private detached residence at 29A Cranmore Gardens.

After discussion, the Committee agreed, with one Member voting against, to adopt the recommendation of the Divisional Planning Manager to approve the above mentioned planning application.

(As the decision was not unanimous it was subject to ratification by the Council.)

64-72 Upper Malone Road

The Committee considered a planning application for a residential development consisting of eight pairs of semi-detached and two detached dwellings at 64 -72 Upper Malone Road in respect of which the Divisional Planning Manager had issued an opinion to refuse.

After discussion, it was

Moved by Councillor M. McGimpsey, Seconded by the High Sheriff (Councillor Patterson),

That the Committee agrees to accept the recommendation of the Divisional Planning Manager to refuse the application.

On a vote by show of hands, ten Members voted for the proposal and two against and it was accordingly declared carried.

(As the decision was not unanimous it was subject to ratification by the Council.)

O2 Radio Base Station on the roof of the Stormont Hotel

The Committee considered an application in relation to the removal of three antenna to be replaced by one flat pole, three antenna and an equipment cabinet at the above-mentioned location. After discussion, it was

Moved by the Deputy Lord Mayor (Councillor O’Donnell), Seconded by Councillor Lavery,

That the Committee agrees to reject the recommendation of the Divisional Planning Manager to approve the removal of three antenna to be replaced by one flat pole, three antenna and an equipment cabinet at the above-mentioned location on the grounds that the proliferation of telecommunications might have a detrimental affect on the health and well-being of local residents.

On a vote by show of hands, three Members voted for the proposal and six against and it was declared lost.

Accordingly, the Committee agreed to adopt the recommendation of the Divisional Planning Manager to approve the above-mentioned application at the O2 radio base station on the roof of the Stormont Hotel.

(As the decision was not unanimous, it was subject to ratification by the Council.)

Planning Appeals

Appeal against Enforcement Notice – Land to the rear of 19 Deramore Park

(The Chairman, Councillor Adamson, declared an interest in this matter in that he was related to the key objector to the application. As there was no discussion in the matter he was not required to leave the meeting.)

The Members’ Support Officer advised the Committee that correspondence had been received from the Planning Appeals Commission indicating that an appeal against an Enforcement Notice at the above-mentioned location had been received.

The Committee agreed that, since it did not approve of unauthorised development, it supported the enforcement action taken by the Planning Service in relation to this matter.

Advanced Notification

The Committee was informed that correspondence had been received from the Divisional Planning Manager indicating that the undernoted application had, under Article 33 of the Planning (Northern Ireland) Order 1991, become subject to an appeal in default of a planning decision:

The Committee was reminded that, in accordance with normal procedures, further letters detailing the recommendations of the Divisional Planning Manager in respect of the above-mentioned application would be submitted to the Committee in due course.

Non-Determination Appeal – Cherryvalley Nursery, King’s Road

The Committee was informed that correspondence had been received from the Divisional Planning Manager in relation to a proposed housing development of mixed dwellings and associated site works at the above-mentioned location. The correspondence indicated that the application had become subject to an appeal under Article 33 of the Planning (Northern Ireland) Order 1991 and that the Department’s view was to grant permission subject to conditions.

The Committee indicated that it still had a number of reservations concerning the proposal but agreed to note the correspondence which had been received.

Planning Applications

Planning Applications Deferred by Members of Council

A Member expressed concern in relation to the large number of planning applications which were deferred at each meeting and he suggested that, with regard to the deferment by Members of planning applications, it would assist the Committee in dealing with applications in an expeditious manner if procedures in this respect were formalised.

The Members' Support Officer stated that, it might prove beneficial if the date on which an application was deferred was recorded on the Schedule of Planning Applications. This would enable the Committee to determine with ease the length of time an application had been deferred. However, he added that it would be appropriate to seek the agreement of the Planning Service in this regard since the Schedule of Planning Applications was compiled by the Planning Service.

The Principal Planning Officer stated that, it should be possible to record the information required on the Schedule of Applications and agreed to refer the matter to the Planning Service for consideration.

The Committee noted the comments of the Principal Planning Officer and agreed that any Member requesting a deferment of an application should detail their reasons for making the request, either directly to the Committee or by informing the Committee Administrator, prior to the meeting.

The Committee was informed that the undernoted planning application, which had been included in the Schedule of Applications, had been submitted in error:
