Minutes
The minutes of the meeting of 4th November, which had been printed and circulated, were taken as read and signed as correct.
Expression of Condolences
The Deputy Lord Mayor (Councillor O’Donnell) referred to the recent death of Councillor Lavery’s brother and the Committee agreed that a letter expressing its condolences and sympathy be forwarded to Councillor Lavery on this sad occasion.
Correspondence Received
It was reported that correspondence had been received from various statutory bodies in connection with the undernoted items:

Copies of the letters, Orders and maps relating to the above-mentioned matters were displayed at the meeting for the information of the Members.
The Committee noted the information which had been received.
Review of Public Administration
The Members’ Support Officer informed the Committee that the Council would soon be involved in further consultation in respect of the Review of Public Administration and he recommended that, in view of the proposal that responsibility for Planning should revert to Local Authorities, a special meeting be held in order to ascertain the views of the Members in this regard. He recommended further that Members of the Development Committee, who were involved in both area and strategic planning, be invited to attend the meeting.
Accordingly the Committee agreed that a special meeting in this regard, to which the Development Committee be invited, be held at a date and time to be determined in conjunction with the Chairman.
Major Planning Application
Site for Housing and Mixed Development and Associated Infrastructure at Hannahstown Hill
The Committee was informed that a letter and associated Environmental Impact Statement concerning the above-mentioned application had been received from Planning Service Headquarters seeking the Council’s comments in relation to the proposal.
The Members’ Support Officer informed the Committee that Planning Service Headquarters would be consulting fully on the application in due course and that the Committee might be wish to reserve its comment until then.
Accordingly, the Committee noted the correspondence which had been received.
Planning Appeal
Non-Determination Appeal – Land between 81 and 85 Old Holywood Road
The Committee was informed that correspondence had been received from the Divisional Planning Manager in relation to the erection of a two-storey detached dwelling at the above-mentioned location. The correspondence indicated that the application had become subject to an appeal under Article 33 of the Planning (Northern Ireland) Order 1991 and that the Department’s view was to grant permission subject to conditions.

Several Members expressed concern that the proposal would result in the destruction of a unique environment with the felling of many old trees. Mr. C. McGuigan, Planning Officer, informed the Committee that the applicant had submitted a report to the Landscaping Department of Planning Service and that it was satisfied that, since the dwelling would be built mainly on the footing of what had previously been intended as a garage, the proposal would have little impact on the surrounding environment.
The Committee disagreed with the view expressed by the Planning Service that the application should be approved on the grounds that the proposal would result in the loss of mature trees and would affect the amenity of the unique site.
The Principal Planning Officer agreed to convey those views to the Planning Appeals Commission and to advise the Committee of the date of the hearing in this regard.

The proposal is contrary to Planning Policy Statement 7: Quality Residential Environments in that it would involve intensification of site usage and coverage in a primarily residential part of the Malone Conservation Area. It would result in overdevelopment of a restricted backland site, inappropriate to the character of the site and the area, and would harm the character of the area through its siting, scale, massing and appearance. The development would result in inadequate private amenity and parking space for prospective residents and would harm the living conditions of existing (adjacent) and proposed residents through overlooking and consequent loss of privacy. 2. The proposed development is contrary to Policy QD1 of the Department’s Planning Policy Statement 7: Quality Residential Environments, and associated guidance, in that the development would, if permitted, cause unacceptable damage to the local character, environmental quality and residential amenity of an established residential area, and would fail to create a quality and sustainable residential environment for the following reasons: - The Development fails to respect the surrounding context and would be highly prominent and visually intrusive when viewed in juxtaposition with the existing development fronting onto Upper Malone Road; and is not appropriate to the character and topography of the site in terms of its siting, layout, scale, massing, design and hard surfaced areas. The extreme gradient of the site cannot satisfactorily accommodate this form of development without the use of prominent retaining structures and excessive excavation works. - The proposal would fail to adequately protect and integrate the natural landscape features of the site into the overall design and layout of the development

- The siting, design and layout of the proposals would harm the living conditions of adjacent and proposed residents by way of dominance, overshadowing, overlooking, poor outlook, and noise and disturbance from the proposed new access road and vehicular movements - The design of the development fails to draw upon the best local traditions of form, materials and detailing, and involves inappropriate house designs in terms of elevations, configurations and orientation - The proposals contravene the Regional Development Strategy 2025 in that the development would constitute town cramming 2. The applicant has not demonstrated that he can achieve a road layout to the Department’s adoption standards 3.
