SPECIAL MEETING OF HEALTH AND ENVIRONMENTAL SERVICES COMMITTEE
Members present: Councillor J. Clarke (Chairman); and Councillors M. Clarke, Convery, Kennedy and Moore.
In attendance:

Environmental Health
Illegal Street Trading – Enforcement Arrangements
The Committee considered the undernoted report in relation to the current and future enforcement arrangements in connection with illegal street trading.
After discussion, the Committee granted the approval sought.
Pilot Community Safety Project – “Operation Clean-up” Campaign
The Committee agreed that those Members who so wished be authorised to `attend the launch of the “Operation Clean-up” Campaign at 12.30 p.m. on 29th November at the Dargan Crescent site, which was being organised by the Department’s Community Safety Unit.
Building Control
Application for the Provisional Grant of an Entertainments Licence
The Pot House Bar and Grill, 26 - 28 Waring Street
The Committee considered a report which had been prepared by the Head of Building Control in relation to an application for the provisional grant of an Entertainments Licence in respect of the above-named premises. A copy of the report, with the exception of the appendices referred to therein, is set out hereunder.
It was reported that Mr. M. Beirne, representing Life Inns Limited, the applicant, was in attendance and he was admitted to the meeting and welcomed by the Chairman (Councillor J. Clarke).
Mr. Beirne stated that, the Pot House Bar and Grill was part of a major investment within the City’s Cathedral Quarter and the complex, which was six stories in height, would accommodate licensed premises on three floors. He pointed out that, in order to attract patrons to the premises, the company wished to provide entertainment from Monday till Sunday from 11.00 a.m. till 3.00 a.m. the following morning.
In response to a Member’s question, Mr. Beirne stated that he wished to provide entertainment in the form of live music, background music and that provided by a disc jockey. He reported that he had extensive experience in running licensed premises and that he did not envisage any problems associated with the dispersement of patrons from the premises. He reported also that taxis which would be collecting customers from the premises would have access through the Waring Street area.
The Chairman (Councillor J. Clarke) thanked Mr. Beirne for his attendance and he retired from the meeting.
Following discussion, it was
Resolved – That the Council, in its capacity as Licensing Authority, be recommended to agree to the provisional grant of an Entertainments Licence in respect of the Pot House Bar and Grill, 26 – 28 Waring Street.
Application for the Renewal of an Entertainments Licence where Objections had been received
Sliabh Dubh, 179 Whiterock Road
The Head of Building Control submitted for the Committee’s consideration a report in relation to an application for the renewal of an Entertainments Licence in respect of Sliabh Dubh, 179 Whiterock Road . A copy of the report, with the exception of the appendices referred to therein, is set out hereunder.
The Head of Building Control informed the Committee that, immediately prior to the commencement of the meeting, the objector and the applicant had reached an agreement regarding the application and the conditions which should be attached to the renewal of the Entertainments Licence. Accordingly, Ms. D. McCorry, the objector and Messrs. D. Adams and T. Clarke, the applicant, together with Mr. T. Jones, Solicitor were admitted to the meeting and both parties confirmed to the Members that they had reached agreement thereon.
The Chairman (Councillor J. Clarke) thanked the representatives for their attendance and they retired from the meeting.
After discussion, it was
Resolved – That the Council, in its capacity as Licensing Authority, be recommended to grant the renewal of a Seven-Day Annual Entertainments Licence in respect of Sliabh Dubh, 179 Whiterock Road, for a period of six months, subject to:
- the fire doors at the premises being closed at all times and used only for emergency purposes; and
- monitoring of the premises to be conducted by officers of the Council, in conjunction with the applicants, to alleviate any noise nuisance emanating from the premises.
Submission of Minutes
Resolved – That, in accordance with Standing Order 12, the minutes of the meeting be submitted to the Council for adoption at its meeting on 1st December.
